These Terms & Conditions (“Terms”) govern the participation of any customer (“Customer”) in a trial of DAYWALK products (“Trial Products”). By accepting or using any Trial Products supplied by Omnituff Group Pty Ltd t/a DAYWALK (“DAYWALK”), the Customer agrees to be bound by these Terms.
1. Purpose of Trial
DAYWALK provides Trial Products for the sole purpose of enabling the Customer to assess suitability, performance, safety, and operational fit prior to any purchasing decision.
The Trial does not constitute a purchase, nor does it oblige either party to proceed with a purchase.
2. Trial Products
DAYWALK will supply the specific Trial Products agreed between the parties. Product descriptions and any indicative pricing provided are for reference only and do not form a quotation or offer.
3. Pricing (Indicative Only)
Any pricing supplied to the Customer is indicative only and subject to formal confirmation.
A binding purchase price will only be provided via an official DAYWALK quotation if the Customer elects to proceed following the Trial.
4. Customer Responsibilities
- During the Trial, the Customer must:
- Use the Trial Products safely and only for their intended purpose.
- Ensure operators follow any user instructions and accepted industry practices.
- Maintain a safe and controlled operating environment.
- Notify DAYWALK immediately of any damage, incidents, or safety concerns.
- Return the Trial Products in the same condition received (fair wear and tear accepted).
- Provide reasonable feedback to DAYWALK at the conclusion of the Trial.
Damage or Loss
If the Trial Products are lost, damaged (beyond fair wear and tear), or not returned, DAYWALK may invoice the Customer for the full replacement value.
5. DAYWALK Responsibilities
DAYWALK will:
- Supply Trial Products in safe working condition.
- Provide available operating or technical information.
- Offer reasonable support to the Customer during the Trial.
- Where reasonably practicable, arrange freight to and from the Customer’s site.
6. Liability
- The Customer is fully responsible for the use and supervision of Trial Products while on their site.
- DAYWALK is not liable for any loss, injury, or damage arising from misuse, incorrect operation, or operation outside intended purpose.
- Both parties agree to act in good faith to ensure safe and appropriate use of the Trial Products.
7. Trial Duration
The Trial will be 2 weeks long.
Any extension must also be agreed in writing.
8. No Commercial Commitment
Participation in the Trial does not obligate the Customer to purchase any product.
Except for the responsibilities set out in these Terms, the Trial does not create any binding commercial agreement.
9. Return of Products
The Customer must return the Trial Products by the agreed end date.
Failure to return items on time may result in additional charges, including replacement value if products are not returned at all.
10. Acceptance of Terms
Use or acceptance of any Trial Products constitutes acceptance of these Terms by the Customer.
